Terms of Use

1. Acceptance of terms

By creating an account, signing in, or otherwise using the platform, you agree to these Terms of Use and the related Copyright & Legal notice. If you do not agree, do not use the platform. System Support may update these Terms at any time; continued use after a change constitutes acceptance.

2. Eligibility & accounts

Accounts are created by restaurant operators or by System Support. You are responsible for keeping your sign-in credentials and PIN confidential and for all activity under your account. Notify Antonio.davis8cfa@gmail.com immediately if you believe your account has been compromised. Inactive or terminated accounts are disabled and can no longer sign in.

3. Your data & privacy

The platform collects the information needed to train, schedule, and develop restaurant teams — names, contact details you choose to add, role and training records, and assignment to a location.

• Sign-in email. Your sign-in address is username@traineetrack.com. Any email or phone number you enter separately is used only for notifications you opt into.
• PINs. A phone number’s last four digits may be used as a fast sign-in PIN on shared devices. The full number is never displayed after entry.
• Scope. Each restaurant can see and act on its own records only. System Support has platform-wide access for support and operations.
• Retention. Records are kept while your account is active and for as long as needed for compliance, then removed per our retention policy.
• No sale of data. We do not sell personal data to third parties.

You may request access to, correction of, or deletion of your personal data by contacting support.

4. Acceptable use

You agree not to:

• Use the platform for any unlawful or unauthorized purpose.
• Access or attempt to access another restaurant’s records.
• Share your credentials or attempt to sign in as another person.
• Upload content that is unlawful, harassing, or infringes others’ rights.
• Interfere with or disrupt the platform’s servers or security.

Violations may result in immediate account suspension and, where applicable, legal action.

5. Billing

Standard restaurant accounts are billed $74.99 every 30 days per restaurant. Billing starts when the restaurant is activated.

• Payment method. Operators add a payment method through the built-in Stripe embedded checkout. We never see or store full card numbers.
• Grace period. If an invoice is not paid, the restaurant keeps access for a 7-day grace period. After the grace period the account is suspended until payment is received.
• Invoices. A PDF invoice is generated and emailed for each cycle, with a secure download link valid for 60 days.
• Refunds. Fees are non-refundable once a cycle has started, except where required by law.
• Manual paid. System Support may mark an invoice as manually paid in special circumstances.

6. Tester program — 1-year free access

Approved testers receive 365 days of free access to the platform, including a dedicated test restaurant so they can explore and add their own team.

• Test environment. Test data is for evaluation only. System Support may reset or remove the test restaurant at any time.
• Term. Free access begins on approval and ends exactly 365 days later.
• No billing during the test. No payment method is required and no invoices are generated while free tester access is active.
• Confidentiality. You agree not to share access, export test data outside the platform, or use what you learn to build a competing product.
• Feedback. Testers are encouraged, but not required, to submit feedback.
• Revocation. System Support may revoke free tester access early for abuse, inactivity, or violation of these Terms.

7. Service availability

The platform is provided on an “as available” basis. We strive for uptime but do not guarantee uninterrupted access. Maintenance, updates, and outages may occur. We are not liable for any loss arising from service interruption.

8. Limitation of liability

To the maximum extent permitted by law, Antonio Davis and the platform are not liable for any indirect, incidental, or consequential damages arising from your use of, or inability to use, the platform. Total liability for any claim is limited to the fees you paid in the preceding 30 days.

9. Termination

You may stop using the platform at any time. System Support may suspend or terminate any account for violation of these Terms. Upon termination, your right to use the platform ends immediately and your data may be removed per the retention policy.
